Workers’ compensation is a no-fault scheme

Queensland’s workers’ compensation system is “no-fault.” This means you’re entitled to claim benefits such as weekly payments, medical expenses, rehabilitation, and lump sums regardless of who caused the accident. Even if the injury was partly your own fault, you may still receive compensation through WorkCover Queensland or a self-insured employer.

Injured workers also have the option of bringing a separate common law claim where negligence is involved.

There are two types of claims: statutory & common law

  • Statutory (No-Fault) Claims – Provide immediate support for lost wages, medical and rehab costs, and lump sum payments for permanent impairment. You don’t need to prove your employer was negligent.
  • Common Law (Fault) Claims – Apply when your employer’s negligence caused or contributed to your injury. These claims allow you to seek higher compensation, including for pain and suffering, lost income, and future medical

Strict time limits apply

Deadlines in workers’ compensation law are tight:

  • Statutory claims – Usually must be lodged with WorkCover within 6 months of becoming aware of the injury.
